Overview

This website, camillejewelry.com, is owned and operated by Camille Jewelry LLC, a New Jersey limited liability company ("Camille Jewelry," "we," "us," or "our"). These Terms of Service ("Terms") apply to everyone who visits our site, creates an account, makes a purchase, requests a custom design, or otherwise uses our services (together, the "Services").

By using our site or placing an order, you agree to these Terms and to the policies referenced in them, including our Privacy Policy, Shipping Policy, and Returns and Exchanges Policy, all of which are part of these Terms. If you do not agree, please do not use our site or Services.

Please read Section 23 carefully. It explains that most disputes must be resolved through individual binding arbitration instead of in court. By agreeing to these Terms, you are giving up your right to go to court and have your claims decided by a judge or jury, and your right to participate in a class action, unless you opt out as described in that section.

Our store is hosted on Shopify Inc., which provides the ecommerce platform that allows us to sell our products to you.

1. Eligibility

You must be at least 18 years old, or the age of majority where you live, to make a purchase, create an account, or enter into a custom design agreement. By using our Services, you confirm that you meet this requirement.

2. Your Account

You are responsible for keeping your account login confidential and for all activity under your account. Please notify us right away at orders@camillejewelry.com if you believe your account has been accessed without your permission. We may suspend or close accounts at our discretion.

3. Orders and Acceptance

Your order is an offer to purchase. An order confirmation email means we received your order, not that we accepted it. We accept your order when it ships. We may refuse, limit, or cancel any order for any reason, including suspected fraud, product availability, errors in pricing or product information, or orders that appear to be placed by resellers. If we cancel an order after you have been charged, we will refund the amount charged.

4. Pricing and Payment

All prices are listed in US dollars unless shown otherwise at checkout. Prices, promotions, and product availability may change at any time without notice. We make every effort to display accurate pricing, but errors may occur. If a product is listed at an incorrect price, we may cancel the order or contact you for instructions before shipping, even after your order is confirmed.

You agree to provide current, complete, and accurate payment and contact information. You authorize us and our payment processors to charge your selected payment method for the full order amount, including applicable shipping, taxes, and duties.

Financing through services such as Shop Pay Installments is provided by third party lenders under their own terms. Camille Jewelry is not a party to those agreements.

5. Canadian Orders

Orders shipped to Canada are processed by Global-e, which acts as the merchant of record for those orders. Payment, duties, and import taxes for Canadian orders are collected at checkout under Global-e's terms, which also apply to your purchase. All Canadian orders are final sale.

6. Product Descriptions and Natural Variations

We describe and photograph our jewelry as accurately as possible. Colors may appear differently depending on your screen, and actual pieces may vary slightly from images in size, color, or finish.

Natural gemstones, pearls, and diamonds are products of nature, and each one is unique. Variations in color, clarity, shape, inclusions, and size are natural characteristics, not defects. Many gemstones are routinely treated or enhanced, which is standard in the jewelry industry.

When a piece contains lab grown diamonds or lab created gemstones, we identify them as such in the product description. Lab grown and natural diamonds are not interchangeable, and you are responsible for reviewing the product description before purchase.

Carat weights are stated as total carat weight unless otherwise noted and may vary within accepted industry tolerances. Measurements are approximate.

7. Materials and Care

Our jewelry is made in materials including solid 14K gold, 14K gold filled, gold vermeil, gold plated sterling silver, and .925 sterling silver. The material for each piece is listed on its product page.

Gold filled, vermeil, and plated finishes are layered over a base metal and may wear with time, friction, moisture, lotions, perfumes, and chlorine. Sterling silver naturally tarnishes. Normal wear, tarnish, fading, scratches, and changes caused by everyday use are not defects.

You are responsible for following the care guidance on our product pages and in our Jewelry Care Guide.

8. Metal Sensitivities

Some people experience skin reactions to certain metals, including metals used in alloys and base layers. If you have known sensitivities, please review the materials listed for each piece and consult your physician before purchase and wear. Camille Jewelry is not responsible for reactions to materials that are accurately disclosed.

9. Safety

Our jewelry is intended for adults. It is not a toy and should be kept away from young children, as small parts, chains, charms, and clasps may present a choking or strangulation hazard. Remove jewelry during sleep, sports, swimming, and physical work. Magnetic clasps and connectors should be kept away from pacemakers and other implanted medical devices.

10. Sizing

You are responsible for selecting the correct size. Please use our Ring Sizer guide or consult a local jeweler before ordering. Resized rings and rings made to your size are final sale.

11. Made to Order and Personalized Pieces

Made to order, personalized, and engraved pieces are created specifically for you and are final sale. Lead times listed on product pages are estimates and are not guaranteed. Once production begins, these orders cannot be changed or canceled. You are responsible for confirming the spelling, characters, and details of any personalization before placing your order.

12. Custom Design and Heirloom Redesign Services

Signed agreement. Every custom design and heirloom redesign project requires a signed Custom Order Agreement before work begins. The Custom Order Agreement and these Terms work together. If they conflict, the Custom Order Agreement controls for that project.

Payment structure. Custom work follows this payment schedule:

  1. Design deposit. After your discovery call, once we agree on a concept and design direction, a $300 design deposit is due before design work begins. This deposit covers design time, sketches, and renderings, and it is nonrefundable.
  2. Production deposit. After you review and approve your pricing quote, a deposit of 60% of the quoted price is due before we order materials or begin production. This deposit is nonrefundable once materials are ordered or production begins.
  3. Final balance. The remaining balance is due when your piece is complete and before it ships or is released to you.

Your piece will not ship or be released until it is paid in full.

Final sale. All custom and heirloom redesign pieces are final sale and cannot be returned, exchanged, or refunded.

Approvals. You are responsible for reviewing and approving sketches, renderings, specifications, sizing, spelling, and engraving text. Once you approve a design, we are not responsible for errors or details in what you approved. Changes requested after approval may add cost and time, and will be quoted before we proceed.

Estimates and timelines. Quotes are based on material costs at the time of quoting and are valid for the period stated in your quote. If metal or stone prices change significantly before materials are ordered, we will contact you with an updated quote before proceeding. Timelines are estimates and are not guaranteed.

Canceling a project. If you cancel a custom project, deposits already paid are not refunded. If costs incurred for materials or labor exceed deposits paid at the time of cancellation, you agree to pay the difference.

Your stones and metals. When you provide your own gemstones, diamonds, metals, or heirloom pieces, you confirm that you own them and have the right to have them altered. Stones may have hidden internal weaknesses, prior damage, or treatments that make them vulnerable during removal, setting, resizing, cleaning, or repair. Camille Jewelry is not responsible for chipping, cracking, breakage, discoloration, or loss of value to customer provided stones or materials that occurs during normal handling and workmanship. Metal lost during refining, casting, or reworking is a natural part of the process. We do not appraise, grade, certify, or authenticate customer provided items, and any identification we share is an opinion only. You are responsible for insuring your items while they are in our care, and our responsibility for customer provided items is limited as stated in your Custom Order Agreement.

Unclaimed items. Completed pieces and customer provided items that are not paid for and picked up or shipped within 90 days after we notify you that your piece is ready may be considered abandoned and handled as permitted by New Jersey law.

Design ownership. Camille Jewelry retains all rights in the designs, sketches, renderings, and design concepts we create, including custom designs. You receive ownership of the finished physical piece once paid in full, but not the right to reproduce the design.

13. Shipping and Risk of Loss

Shipping terms are described in our Shipping Policy. Delivery dates are estimates and are not guaranteed. Title and risk of loss pass to you when the carrier delivers your order to the address you provided. Orders valued at $750 and above ship insured, as described in our Shipping Policy. You are responsible for providing an accurate and secure delivery address.

14. Returns, Exchanges, and Refunds

Returns and exchanges are governed by our Returns and Exchanges Policy. Final sale items, including sale items, made to order pieces, personalized and engraved pieces, resized rings, custom designs, heirloom redesigns, and all international orders, cannot be returned or exchanged.

15. Limited Warranty

We stand behind the craftsmanship of our jewelry. If a piece has a manufacturing defect in materials or workmanship, please contact us at orders@camillejewelry.com within 30 days of delivery with photos, and we will repair or replace it at our discretion. Repair or replacement is your sole remedy under this limited warranty.

This limited warranty does not cover normal wear, tarnish, fading of plated or layered finishes, scratches, stretched or broken chains caused by pulling or snagging, lost stones resulting from impact, loss or theft, damage from chemicals or water, improper care, accidents, or pieces that have been altered or repaired by anyone other than Camille Jewelry.

16. Chargebacks and Payment Disputes

If you have a problem with your order, please contact us first so we can make it right. Filing a chargeback for a delivered order, a final sale item, a custom project, or an item that was returned in a condition that does not meet our policy may result in cancellation of your account and future orders. We reserve the right to submit order records, signed agreements, approvals, delivery confirmations, communications, and these Terms to your card issuer in response to any dispute.

17. Promotions and Discounts

Promotional codes are limited to one per order unless stated otherwise, have no cash value, cannot be applied to past purchases, and may be changed or ended at any time. We may cancel orders that use codes obtained or applied improperly.

18. Gift Cards

If we offer gift cards, they can be used only for purchases on camillejewelry.com, do not expire, and carry no fees. Gift cards cannot be redeemed for cash, reloaded, or resold, except where required by law. Please treat gift cards like cash. We are not responsible for gift cards that are lost, stolen, or used without your permission. Gift cards cannot be used to purchase other gift cards. Purchases of gift cards are final.

19. Text Messages and Email

By subscribing to our text messages, you agree to receive recurring automated marketing messages at the number you provided. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to cancel or HELP for help. Carriers are not liable for delayed or undelivered messages.

By providing your email address, you agree that we may send you order updates and, if you opt in, marketing emails. You can unsubscribe at any time.

You agree that all notices and communications we send electronically satisfy any legal requirement that they be in writing, and that electronic signatures on any agreement with us are as binding as handwritten signatures.

20. Intellectual Property

All content on our site, including jewelry designs, photographs, videos, text, graphics, logos, the Camille Jewelry name, and site design, is owned by or licensed to Camille Jewelry LLC and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, modify, distribute, sell, or create derivative works from our designs, images, or content without our written permission. This includes manufacturing, selling, or promoting copies or imitations of our designs, using our photographs on other websites or marketplaces, and using our content to train artificial intelligence or machine learning systems. We actively protect our designs and will enforce our rights.

21. Reviews, Photos, and Submissions

When you submit a review, photo, video, comment, or idea, or tag or mention Camille Jewelry on social media, you grant us a worldwide, royalty free, perpetual, nonexclusive license to use, reproduce, edit, display, and share that content, along with your first name and last initial or social media handle, in any media, including marketing and advertising. We will request your permission before featuring content you post on your own social media accounts in paid advertising.

You confirm that your submissions are your own, are truthful, reflect your genuine experience, and do not violate the rights of anyone else. We may remove any submission that is unlawful, offensive, or unrelated to our products. We do not pay for reviews or suppress honest reviews.

22. Prohibited Uses

You may not use our site or Services to:

  • Violate any law or regulation
  • Infringe our intellectual property or anyone else's
  • Submit false, misleading, or fraudulent information or orders
  • Harass, threaten, or harm others
  • Upload viruses or harmful code
  • Scrape, crawl, or collect data from our site by automated means, including for artificial intelligence training
  • Interfere with the security or operation of our site
  • Resell our products commercially without our written permission

We may suspend or end your access to our Services if you violate these Terms.

23. Dispute Resolution and Arbitration

Informal resolution first. Before starting any claim, you agree to email orders@camillejewelry.com with your name, order number, a description of your concern, and the resolution you are seeking, and to give us 30 days to try to resolve it. We will do the same before bringing a claim against you.

Binding arbitration. If we cannot resolve a dispute informally, you and Camille Jewelry agree that any dispute arising from or related to these Terms, our site, our Services, any product, or any custom project will be resolved by final and binding individual arbitration, rather than in court, except as described below. This means you are giving up your right to have your claims decided in a court of law by a judge or jury. Arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitrator's decision is final and may be entered as a judgment in any court with jurisdiction. The arbitration may be conducted by video, by phone, or based on written submissions. If an in person hearing is required, it will take place in the county where you live or another location we both agree on. For claims under $10,000, we will pay the filing and arbitrator fees that exceed what you would pay to file in court, unless the arbitrator finds your claim was frivolous.

Exceptions. Either of us may bring an individual claim in small claims court if it qualifies. Either of us may also go to court to stop infringement or misuse of intellectual property, or to collect an unpaid balance.

Class action waiver. You and Camille Jewelry agree that each of us may bring claims against the other only individually, and not as a plaintiff or class member in any class, collective, or representative action. The arbitrator may not combine claims of more than one person.

Jury trial waiver. To the extent any dispute is heard in court, you and Camille Jewelry each waive the right to a jury trial.

Opting out. You may opt out of this arbitration agreement by emailing orders@camillejewelry.com with the subject line "Arbitration Opt Out" within 30 days of first accepting these Terms. Your email must include your name, your mailing address, and a clear statement that you are opting out.

Where arbitration is not permitted. This Section 23 does not apply to residents of places where mandatory consumer arbitration is prohibited, including Quebec. If the class action waiver is found unenforceable for any claim, that claim will be decided in court, and the rest of this section will still apply.

24. Time Limit to Bring Claims

To the fullest extent permitted by law, any claim arising from or related to these Terms, our Services, or any product must be brought within one year after the claim arises. Claims not brought within that time are permanently barred. This time limit does not apply where the law prohibits shortening it.

25. Disclaimers and Limitation of Liability

Except for the limited warranty in Section 15 and to the fullest extent permitted by law, our site and Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and noninfringement. We do not guarantee that our site will be uninterrupted, secure, or free of errors.

To the fullest extent permitted by law, Camille Jewelry LLC and its members, managers, employees, contractors, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or sentimental value, arising from or related to your use of our site, our Services, any product, or any custom project, even if we were advised of the possibility of those damages.

To the fullest extent permitted by law, our total liability for any claim arising from or related to these Terms, our Services, any product, or any custom project will not exceed the amount you paid to Camille Jewelry for the product or service that gave rise to the claim.

New Jersey residents: Nothing in these Terms limits any right you have under New Jersey law that cannot be waived by contract, including rights under the New Jersey Consumer Fraud Act and the Truth in Consumer Contract, Warranty and Notice Act. The disclaimers and limitations in Sections 24 and 25, the release in Section 26, and the indemnification in Section 27 do not apply to you to the extent New Jersey law prohibits them. Any provision that is unenforceable under New Jersey law is limited to the fullest extent New Jersey law allows.

Other residents: Some states and provinces do not allow certain warranty disclaimers, limitations of liability, or shortened claim periods. If you live in one of those places, some of the limitations above may not apply to you, and you may have additional rights under local law.

26. Release

If you have a dispute with a carrier, payment provider, financing provider, or other third party, you release Camille Jewelry from claims arising from that third party's actions, to the fullest extent permitted by law.

27. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Camille Jewelry LLC and its members, managers, employees, contractors, and service providers from any claims, losses, and expenses, including reasonable attorneys' fees, arising from your violation of these Terms, your misuse of our Services, your submissions, any items you provide to us that you do not have the right to provide, or your violation of any law or the rights of others.

28. Third Party Services and Links

Our site may include tools, content, or links provided by third parties. We do not control and are not responsible for third party websites, services, or products, and your use of them is at your own risk and subject to their terms.

29. Errors and Changes to Our Services

Our site may occasionally contain errors related to product descriptions, pricing, promotions, shipping charges, transit times, or availability. We reserve the right to correct errors, update information, and cancel orders affected by errors at any time, including after an order is placed. We may modify, suspend, or discontinue any part of our Services at any time.

30. Circumstances Beyond Our Control

We are not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, severe weather, carrier delays, supplier delays, supply shortages, material price changes, labor disputes, government actions, pandemics, power or internet outages, and cyberattacks.

31. Governing Law and Venue

These Terms are governed by the laws of the State of New Jersey and applicable federal law, without regard to conflict of law principles. Subject to Section 23, any court action will be brought exclusively in the state or federal courts located in Camden County, New Jersey, and you consent to the jurisdiction of those courts.

32. Termination

We may suspend or end your access to our Services at any time if you violate these Terms or if we suspect fraud. Sections that by their nature should continue after termination, including those covering payment, custom projects, intellectual property, warranties, time limits, limitation of liability, dispute resolution, and indemnification, will continue to apply.

33. General Terms

These Terms, together with the policies referenced in them and any signed Custom Order Agreement, are the entire agreement between you and Camille Jewelry LLC and replace all prior versions. If any part of these Terms is found unenforceable, that part will be limited to the minimum extent necessary, and the rest will remain in effect. Our failure to enforce any provision is not a waiver of our right to do so later. You may not transfer your rights under these Terms. We may transfer ours, including in connection with a sale or merger of our business. Section headings are for convenience only.

34. Changes to These Terms

We may update these Terms from time to time by posting the revised version on this page and updating the "Last updated" date. Changes apply to orders placed and use of our Services after the updated Terms are posted. Changes to Section 23 will not apply to any dispute you have already notified us about.
